Divorce for Real Housewife of DC

Tareq Salahi has filed for divorce from Michaele Salahi, White House gate crasher and one of the Real Housewives of DC.

Tareq accuses Michaele of desertion and adultery with Journey guitarist Neal Schon.

In the Complaint, Tareq claims Schon sent Michaele a picture of a part of his body via email.

There is no lawyer’s name on the Complaint, but it appears to be drafted by someone who knows divorce law.  There is no mention of a prenuptial agreement.

Tiger Woods found out the hard way.

If you are going to cheat, your spouse will find out about it.  There are no secrets.  Your paramour will tell somebody or somebody will see you together.  That somebody will tell someone else.  Eventually word will get back to your spouse.

Actions have consequences.  You may think they don’t, but they do.  Ask any divorce lawyer.  If you’re going to play, you have to pay.  Think about the consequences before you act.  Is it worth the cost?

You choose your actions.  You can choose to be faithful and committed to your marriage or not.  But affairs don’t just happen.  People don’t fall out of love with their spouses.  They make a choice.  What choices are you making in your life?

Michael Foti, the marketing director at NewLawyer.com says the purpose of the website is to “provide legal advice to anyone and everyone who needs it.”

CHAPTER TWO – SAYING HELLO

Falling in love is as easy as falling off a log.  Staying in love, however, is a decision.  Marriage is hard work.  It takes commitment and compromise.

When you are with someone every day for a long time, you tend to take them for granted.  The problem with this is it makes them feel like you are taking them for granted.

Here is my solution.

Greet your spouse with enthusiasm and energy.  Show them you are happy to see them.  Smile and say “Hello!  How are you, dear?”

Don’t make your first words “What’s for dinner?” or “The kids were terrible today.”  Show your spouse, by your actions and words, that you are happy that you found them and grateful to be married to them.

Celebrate your spouse every time you see them – when you wake up in the morning, when you come home from work or your spouse comes home from work.

By small gestures, strong bonds are made.  It only takes a second, but it takes so little to do so much.  See Chapter One.

To Crave Oyer

A client asked me this morning if she could just write a letter to the judge telling her side of the story.  The answer is no.  The rules require certain formalities and a letter will usually be returned by the clerk or the judge with a polite note.

Our law comes from England where each cause of action had a formality which had to be pled specifically.  Today we have notice pleading which allows for more leeway, but there are still many vestiges  of formal pleading left.

For example, one of my partners, John Thyden, once filed a Motion to Crave Oyer in a lawsuit.

I happened to be talking to his opposing counsel about another case one day when the conversation strayed to my partner’s motion.  He told me that the lawyers in his firm had to look up “crave oyer” in Black’s Law Dictionary to see what it meant.

It means to demand to see a copy of the document being sued upon, like a contract, a promissory note or a deed.

From then on, said the attorney, Thyden was referred to at that law firm as the “Crave Oyer Lawyer”.

Advice for Sarah Palin

I’m not sure what I would say if Katie Couric asked me to name some Supreme Court decisions.

But an older lawyer once told me if the judge asks you for a citation, and you can’t think of anything, go to the colors.

Judge:  “What’s your authority, counselor?”

Lawyer:  “Uh, Judge, I think that’s the Green case.” (or the White case or the Brown case.)

If Sarah had said the Brown case, she would have had one right.  In Brown vs. the Board of Education, the Supreme Court held that segregation of public schools was unconstitutional.   And while a lawyer has to exercise candor with the court, there is no such restriction on a politician.
